The California Supreme Court ordered that Proposition 77 remain on the ballot. The Attorney General filed an action in Superior Court, seeking to have the measure removed from the ballot. The Superior Court agreed with the Attorney General and, on appeal, so did the Court of Appeal. The California Supreme Court subsequently allowed the measure to proceed, ruling that "it would not be appropriate to deny the electorate the opportunity to vote" on the measure. Should the voters approve Proposition 77, the Supreme Court will then consider the legal issues surrounding the different versions and decide whether to let the vote results stand.
